OLSPN planning appeal High Court 16th November

The OLSPN School planning enforcement appeal reaches the High Court next week. It will be heard by Mrs Justice Lang DBE in the Planning Court of the Queen’s Bench, on Tuesday November 16th. It will be held at the RCJ, and I am not sure whether you can follow it virtually.

The Archdiocese of Southwark has had its appeal against planning enforcement refused on each of its appeal grounds.

Has that even been suggested, or is this just the Archdiocese’s Education Commission constructing a straw-man?

Demolition is being used by the Archdiocese to try and demonise the enforcement process. Paraphrasing the situation, by my understanding, the building has to conform with the original plans, but there is the expectation they negotiate with Lewisham to vary details,which they have refused to do. The rules say that they have to conform with the plans even if this requires demolition. Lewisham has repeatedly shown it is willing to compromise, and objectors also want to make pragmatic choices to mitigate the complete mess we are living with.

However, the Archdiocese keeps claiming they are being told to demolish the school. This would only be necessary if it transpires that underneath the cladding, the build doesn’t conform with building regs, or cannot be adapted safely. Do they know something we don’t know?
